The SDNY recently granted a Motion to Dismiss in favor of WHIPgroup clinet, Koslow Technologies Corporation, securing a $18M Arbitration Award.
Back in March, WHIPgroup client, Koslow Technologies Corporation (Koslow), was awarded a $18M Partial Final Arbitration Award by a three-attorney Tribunal of the International Center for Dispute Resolution (ICDR). The award was the result of lawsuit filed in the SDNY by One World Filter Corporation seeking over $1B on a contract claim related to gravity water filters which remove viruses.
After failing to obtain a TRO or PI, we moved the case to the IDCR (a division of the American Arbitration Association). The Tribunal of the ICDR ruled in favor of Koslow, awarding $18M in unpaid exclusive license fees and pre-judgement interest. Koslow was also awarded attorneys fees and costs.
After the $18M Partial Final Award was issued, the opposing party, One World Filter Corporation, filed a Motion to Vacate the Award in the SDNY. WHIPgroup quickly filed a Motion to Dismiss One World’s Motion to Vacate and the SDNY recently granted our Motion to Dismiss.
