Infogation Corporation filed a patent infringement lawsuit in EDTX against WHIPgroup client, TomTom International B.V.
TomTom International B.V., a Netherlands corporation, was never served papers related to the lawsuit. However, service was attempted on TomTom North America, Inc., TomTom Internation’s U.S.-based subsidiary.
TomTom North America, Inc. is not a party to the lawsuit filed by Infogation. TomTom North America isn’t authorized to accept service on behalf of TomTom International.
Infogation seemed to believe that serving TomTom North America would be a valid service of process to TomTom International.
WHIPgroup filed a Motion to Dismiss (linked below) challenging sufficiency of service on TomTom International.
