WHIPgroup obtained a Judgment for its client New Leaf Data Services against Humboldt Marijuana Exchange for trademark infringement as well as cyber-squatting and commercial disparagement. The Court found that Humboldt Marijuana Exchange willfully infringed New Leaf’s registered trademarks for CANNABIS BENCHMARKS and HEMP BENCHMARKS even after being put on notice of New Leaf’s rights. The Court granted New Leaf Data Services a $400,000 monetary award as well as a permanent injunction preventing Humboldt Marijuana Exchange from using the trademarks or confusingly similar versions. The Judgment and Permanent Injunction were reported by Law360 in a February 4 article titled “Pot Data Co. Wins $400K Over Rival’s TM Infringement,” which can be viewed here.
