WHIPgroup obtained a successful outcome for its client in which all rejections were reversed by the Patent Trial and Appeal Board. The claimed invention concerns a graphical user interface of a process control system used for monitoring and control purposes in an industrial installation. The Examiner had rejected the claims as being obvious over two references. On appeal, WHIPgroup argued that the references failed to teach view integration. The Board was convinced by WHIPgroup’s arguments, finding not only that the references described overlapping graphical windows, but that the Examiner’s analysis read the key element out of the claims. Issuance of a patent containing all pending claims is expected in due course.
