January 2, 2025 marks a momentous day for Margo Kirby and her late husband Bruce Kirby.
After a nearly 12-year legal battle in federal court, including an appeal to the Second Circuit, a federal judge in the U.S. District Court of Connecticut entered judgment in favor of Bruce Kirby, Inc. on its Lanham Act claims (Counts One and Two) against Quarter Moon, Incorporated (“QMI”), as well as judgment in favor of Margo Kirby, Executor of the Estate of Bruce R. W. Kirby, and against Quarter Moon, Incorporated and LaserPerformance (Europe) Limited for misappropriation of Kirby’s name (Count Three).
The Court’s judgment is long-awaited justice for the Kirby family who continue to seek accountability for the Defendants’ illegal acts even after the passing of Bruce in 2021.
