WHIPgroup successfully obtained an Order of Preliminary Injunction in connection with a Complaint and Emergency Motion for Temporary Restraining Order and Preliminary Injunction filed in the U.S. District Court for the Northern District of Georgia on behalf of its client Ecochem Australia Pty Ltd., of Victoria, Australia.
Ecochem is an eco-friendly, worldwide manufacturer and supplier of cleaning products and systems, particularly in the corrugated packing industry.
The dispute arose over a distribution agreement with Defendant CST Systems Inc. and alleges CST has infringed Ecochem’s trademarks and has failed to comply with the multiple terms of the distribution agreement.
The preliminary injunction prevents CST from using Ecochem’s trademarks and selling products that compete with those of Ecochem, such as cleaning systems and chemicals in the corrugated packing industry.
The case is Ecochem Australia Pty Ltd. v. CST Systems, Inc., Civil Action No. 1:22-cv-4908-TWT (N.D. Ga.). WHIPgroup attorneys Michael Kosma and Robert Keeler represented Ecochem at the Preliminary Injunction Hearing.
