WHIPGroup filed a Motion to Dismiss for improper venue in the Western District of Texas on behalf of its client TomTom North America, Inc. Plaintiff MDSP Technologies LLC alleges that TomTom North America, Inc. infringes its patents US 9,239,376 and US 10,371,806. However, in the Motion to Dismiss, WHIPGroup argued that MDSP Technologies LLC failed to plead that TomTom North America’s contacts meet the heightened venue standard under 28 U.S.C. § 1400(b) required in patent infringement suits.
